For the fifth consecutive year, Syspirosi Atakton, an anarchist, anti-authoritarian, anti-oppressive group rooted in Nicosia organizes the Genders and Power festival.

The aim is to discuss and elaborate on the ways genders, in their intersections with multiple sociopolitical and cultural categories of difference, interact in myriad ways and arbitrarily produce systemic inequalities. This year, discussions will focus on women’s agency, reproductive justice, lesbian desire, and queer Cypriot art. Abjected voices and their resistance to hegemonic power structures will be put at the center of our struggle. Genders and Power festival neither essentializes nor naturalizes identities or experiences of any kind. It rather seeks to signalize, understand and deconstruct various societal systemic power relations in order to resist them; and here lies its political importance. Accountability, situatedness, and self-reflexivity are all really important elements of our festival’s approach as it seeks to denormalize and delegitimize power differentials and categories through engaging discussions, interactive performances, and parties with politics. [Beyond Europe] Going for the revolutionary 8th of March!

On this 8th of March, Beyond Europe takes an antiauthoritarian, anti-capitalist and anti-nationalist stance in the feminist struggles. This means that we are moving beyond traditional borders and radicalizing hegemonic narratives. The traditional approaches that link patriarchy either only to the state or capitalism need to be overridden so that they can be considered antiauthoritarian.

By drawing attention to the facts that patriarchy is the oldest system of oppression but also has the ability to move beyond borders and norms, we call upon its authoritarian structure.

Let’s fight authority on all its levels: from the local to the transnational. Join us in solidarity by supporting your local groups which strive for feminist demands.

We, as Beyond Europe, gathered today outside the Archibishop´s  Palace in solidarity of feminist struggles. Particularly, we aim to support the demands for reproductive justice in Cyprus, since abortion is still illegal. There are currently initiatives for decriminalizing abortion in the law and Church of Cyprus is one of the forces who are actively against abortion as well as other political and wider eco-social struggles.

Short-statement on the gathering of Beyond Europe – Antiauthoritarian Platform Against Capitalism in Nicosia (Cyprus) from the second to the fourth of March 2018

Last weekend antiauthoritarian groups from all over Europe came together in the divided town of Nicosia on the Island of Cyprus, located in the eastern corner of the Mediterranean Sea. Some of us hadn’t seen each other since the riotous nights of the G20 summit in Hamburg in July of last year, while many met for the first time. In 2013, when the platform Beyond Europe was formed, we were riding a wave of emancipatory unrest all over Europe, the United States of America and Northern Africa. This unrest was reacting to the economic crisis of 2008 and how it was handled politically. Today we are facing a different beast. It has risen out of the crackdown of this wave of unrest by the cooperation of neoliberal and authoritarian regimes. What we find as a result of the normalisation of the crisis through the policing of the social and militarization of the police-force is this: A massive resurgence of nationalism and populism in their many intersections with the various guises of authoritarianism and patriarchy. Going back to the recipes of the past, their promise is the promise of an easy solution. Politicians of all colors keep telling us that what separates us are the irreconcilable ‘natures’ of our ethnicities, nationalities, identity cards and genders, of our belonging. But if three days of discussions with fifty people from five countries and eleven cities has proven one thing, it is that this is a lie.

Under global capitalism, more connects us than it separates us. The culturalisation and naturalisation of bourgeois politics and capitalist economy does not solve one single contradiction arising from them. It simply displaces and externalises them. In this way it hinders progressive politics. Its discursive and material prominence is a danger for the safety and livelihood of everything different. The changed situation thus demands of us to take critical stock of our previous attempts. We are still few, weak and isolated. Our own reproduction often depends on the system and the mechanisms we seek to overcome. And we struggle to make our different histories as movements and the circumstances under which they were formed productive. But in a world divided by borders and classes, brutalized and depraved, we are far more surprised by how much common ground there is among us – how similar our desires for a different world are, and how careful we sometimes can be with each other. In several working groups this weekend – on labour and digitalisation, eco-social-struggles, feminist politics, the authoritarian formation and the rise of new fascisms – it became clear that our answer cannot be retreating into a position of self-defense. Even though they were won only by and after hard-fought battles of social movements, liberal rights or the social-democratic welfare state would not be able to counter Nationalism and Capitals even if they were tenable in the current situation. Nationalism and Capitalism are implicated in liberalism and social democracy, managing their on-going proceedings and enacting their exclusions. Instead, we need to expand and proliferate our struggles over the collective self-organisation of our lives: In the household and the neighborhood, the factory, the call-center, cyberspace, on the school-yard or the lecture hall, the fruit plantation, the coal mine or the hospital. The social and democratic experiment of Rojava, erected and defended admit the horrors of the Syrian war, surely is one example. The movement of #blacklivesmatter is another.

Together we will have to figure out what is to be done with so many issues and only very limited resources on our hands. This will take some time and we warmly invite you to join the discussion. This much is clear: It is only together that we can overcome the obstacles erected between us and the construction of a better life – be it the exploitation of our work, of our life or of our environment for the sake of profit and power. Whatever its form, Capitalism will continue to produce misery, surplus populations, war and the destruction of the Earth. So antiauthoritarian politics will have to change, but our goal remains the same: To move beyond state, nation and capital, be it in their national or supernational European incarnations. The California Coastal Act for decades has scaled back mega-hotels, protected wetlands and, above all, declared that access to the beach was a fundamental right guaranteed to everyone.

But that very principle could be dismantled in the latest chapter of an all-out legal battle that began as a local dispute over a locked gate.

On one side, property owner and Silicon Valley billionaire Vinod Khosla wants Martins Beach, a secluded crescent-shaped stretch of sand and bluffs, to himself. On the other, generations of beachgoers demand continued access to a path long used by the public. The squabble has spurred a spate of lawsuits that now focus on whether Khosla needs state permission to gate off the road — and a string of California courts has said he does.

Unwilling to back down, Khosla is now appealing to the U.S. Supreme Court over his right to shut out the public. His latest argument not only challenges the constitutionality of the Coastal Act — if taken up by the nation’s highest court, it would put into question long-established land use procedures and any state’s power to regulate development anywhere.

“It’s bold, it’s arrogant, it wants to strike at the core of our society,” said Joe Cotchett, lead attorney for the Surfrider Foundation, which sued Khosla in its fight for public coastal access. “This is so much bigger than a little beach in San Mateo County. It’s a steppingstone to every coastline in the United States.”

Khosla, not short on money nor shy on tactics, has tapped a new lawyer uniquely suited to overcome the longshot odds of bringing this argument before the nation’s nine top justices. Now leading his legal team is Paul Clement, who served as U.S. solicitor general under President George W. Bush, has clerked for the late Justice Antonin Scalia and “argued more Supreme Court cases since 2000 than any lawyer in or out of government,” according to his professional bio at Kirkland & Ellis LLP.

He has defended a number of conservative positions, such as arguing against same-sex marriage and leading the legal challenge against President Obama’s Affordable Care Act.

In his 151-page petition to the Supreme Court, Clement described California’s coastal policies as “Orwellian” and made the case that private property should not be taken for public use without just compensation: “the Coastal Act cannot constitutionally be applied to compel uncompensated physical invasions of private property.”

Clement and Khosla’s team of Bay Area lawyers did not respond to requests for comment. Khosla declined to comment for this article.

The Supreme Court will probably decide in the next three months whether to take up the case. Chances are slim: Of the thousands of appeals filed each year, only about 100 are granted review. But with conservative interpretations of property rights gaining prominence and President Trump’s recent appointment of Justice Neil M. Gorsuch, having the right lawyer and a well-crafted argument might just be enough to win the four Supreme Court votes needed for the case to move forward, legal experts said.

Khosla’s arguments, while ambitious, are “artfully drafted in an effort to capture the attention of at least four justices,” said Richard Frank, director of the California Environmental Law and Policy Center at UC Davis. “This petition is targeted directly at the conservative wing of the United States Supreme Court, and it certainly is plausible that the court could grant review in this case given the quality of representation and the issues involved.”

The issues date back to 2008, when Khosla, a co-founder of Sun Microsystems, bought the 89-acre property south of Half Moon Bay for $32.5 million.

The Deeney family that sold Martins Beach had, for almost a century, maintained a public bathroom, parking lot, even a general store. Surfers, fishermen and picnickers paid 25 cents to enter. The fee eventually went up to $10.

Khosla, in legal filings, said he “was willing to give the business a go, and continued to allow members of the public to access the property upon payment of a fee. But [he] soon faced the same problem the Deeneys had faced: The business was operating at a considerable loss, as the costs of keeping the beach, the parking lot and other facilities in operable and safe condition significantly exceeded the fees the business generated.”

So he shut the gate, hired security and posted “do not enter” signs.

A number of public interest groups have since sued Khosla. He, in turn, has sued the California Coastal Commission, the State Lands Commission and San Mateo County, over what he considered an interference of his property rights.

A San Mateo County Superior Court judge, however, dismissed his case, stating that he had to go through the commission’s permit process or enforcement proceedings before he could resort to a lawsuit.

The case that could be heard by the U.S. Supreme Court began when Surfrider sued Khoslaon the grounds that he failed to apply for the development permit required to change public access to the coastline. A local court sided with Surfrider and a state appeals court upheld that decision, ordering Khosla to unlock the gate while the dispute continues. Khosla appealed again to the state Supreme Court, which declined to hear the case.

Nowadays, the gate is sometimes open, sometimes closed. Sheriff’s officials have said it would not arrest members of the public for trespassing. The Coastal Commission last fall began the formal process of notifying Khosla of public access violations, which could amount to fines of as much as $11,250 per day per violation.

The commission, not an official party to the Surfrider suit, said it is reviewing Khosla’s appeal to the Supreme Court. The state attorney general’s office said it was aware of the petition and provided no additional comment.

Khosla is not the first wealthy landowner to challenge coastal regulations. Many still recall the 22-year fight with music producer David Geffen to unlock his Malibu gate. (Geffen eventually handed over the keys).

But not all fights have ended in public victory. When the Coastal Commission demanded in the 1980s that James and Marilyn Nollan allow the public to walk on their beachfront in Ventura in exchange for obtaining a building permit to enlarge their house, the Supreme Court ruled the agency had gone too far.

In handing down the 1987 Nollan vs. California Coastal Commission decision, Scalia compared the commission’s tactics to “an out-and-out plan of extortion.” The first of a number of rulings in which the court tilted the law toward protection of property rights, it dramatically scaled back the commission’s power to require public access ways to the coast.

“Nollan had a catalytic effect, and I expect any decision in the Martins Beach case … would have a similar sweeping and catalytic effect on public access law and property rights more generally,” Frank said. “It’s one of those landmark foundational cases that is cited all the time throughout the nation and has prompted more litigation.”

Ralph Faust, who was the commission’s general counsel from 1986 to 2006, said a striking difference between the Nollan case and Martins Beach is that Khosla is challenging the Coastal Act “as written, not as it’s applied.”

Nollan applied for a permit but didn’t like the stipulations the commission required, so he challenged them, Faust said. Khosla is skipping that step altogether and arguing that the requirement to seek a permit — as well as the state court injunction to maintain the status quo of keeping the gate open while the matter is being decided — violates his rights as a property owner.

“That’s a pretty stunningly broad attack on state government,” Faust said. “If he were to win on that and just get a declaration that the Coastal Act could not possibly be constitutionally interpreted to require a permit for that kind of development — that would be just huge.”

The Nollan case unfolded in unexpected ways and to this day affects the way access rights are argued and how land should be set aside for the public, Faust said. Should the Supreme Court take up Khosla’s appeal, the implications are beyond imaginable.

“Just because you think you know what the situation is when you’re talking about a case, doesn’t mean that’s how it’s going to look if the Supreme Court actually decides something,” he said.

“These things take on a life of their own.”

The city as the main field of social activity and action reflects the wider social environment. Ecopolis festival aims to reveal, challenge, and renegotiate the social tensions of everyday life in the streets, squares and benches of Nicosia. A city that is drowning in coffee shops, street-side tables and fashionable bars. The old city of Nicosia has changed face: from sub-developed historical center it has now fulfilled its potential as an ideal city-commodity, maintaining the advertisable image of the “last divided capital”, while the accelerated gentrification of the last years has constituted it as an urban jewel “clean” from social relations and situations that oppose commodity relations mediated by spectacle.

Skyscrapers for high-class apartments and businesses, pedestrian zones occupied by the tables of countless interchangeable shops, the lack of public benches, fences around Faneromeni church that get taller every year, sidewalks full of parked cars, sky-rocketing rents that become prohibitive for migrant residents –all a result of gentrification and the consumerist influx which followed, creating a city where the only acceptable social / political activity is consumption. Meanwhile, barbed wire, barrels and armies force us us to live our geographical and historic site as half, mediated by the symbols of hatred and tedious queues at the checkpoints to walk a distance of 100 meters.

For us, these are factors composing a challenging landscape of action, in which we intervene creatively by expressing and making proposals for societies organized outside hierarchical, capitalist and sexist mentalities and institutions, on the basis of self-organization, solidarity and companionship. The Ecopolis festival is being held this year for the first time by the Ecopolis working group on ecology and the city. Ecopolis festival aims to put forth the claim to the city as a Common, as a field of resistance to the social and environmental endeavors of neoliberalism. We want to create the conditions in which the city is experienced as a point of reference and socialization, action and experimentation, rather than as a polished real estate commodity bought and sold according to the laws of the market and current trends.

Πλαίσιο αναφοράς

Επί της γενικής αρχής, η Πρωτοβουλία για τη Διάσωση των Φυσικών Ακτών θεωρεί ότι η θάλασσα αποτελεί κοινό αγαθό και αναπόσπαστο μέρος του δημόσιου πλούτου. Ως εκ τούτου, η Κυπριακή Δημοκρατία οφείλει να διασφαλίσει τη μακροπρόθεσμη διατήρηση και ολοκληρωμένη διαχείριση του θαλάσσιου χώρου, και την διασφάλιση του ως δημόσιο αγαθό.

Αντ’ αυτού, παρατηρούμε συστηματικές προσπάθειες με στόχο την αποξένωση / εκχώρηση και οικειοποίηση / ιδιωτικοποίηση του θαλάσσιου χώρου. Τονίζουμε την έλλειψη στρατηγικού σχεδιασμού όσον αφορά θαλάσσιες δραστηριότητες, την έλλειψη διαφάνειας και την περιορισμένη διαβούλευση, την ανεπαρκή αιτιολόγηση των αναγκών που καλούνται να καλύψουν οι συγκεκριμένες τροποποιήσεις, αλλά και τη σύγκρουση / ασυμβατότητα των προτεινόμενων Κανονισμών με την ισχύουσα νομοθεσία και τις υποχρεώσεις της Κυπριακής Δημοκρατίας ως Κράτους Μέλους της ΕΕ.

Το υπό συζήτηση νομοσχέδιο, με τίτλο «Οι περί της Σύμβασης για την Προστασία της Μεσογείου Θάλασσας από τη Ρύπανση και περί Συναφών Πρωτοκόλλων (Τεχνητοί Ύφαλοι) Κανονισμοί του 2018» προβλέπει την έκδοση κανονισμών κατόπιν απόφασης του Υπουργικού Συμβουλίου, «ασκώντας τις εξουσίες που του χορηγούνται με βάση το άρθρο 6 των περί της Σύμβασης για την Προστασία της Μεσογείου Θάλασσας από τη Ρύπανση και περί συναφών Πρωτοκόλλων (Κυρωτικών) Νόμων του 1979 μέχρι 2017».

Οι προτεινόμενοι κανονισμοί, σύμφωνα με το Άρθρο 3 («Πεδίο Εφαρμογής») θα:

«(1) εφαρμόζονται στους τεχνητούς υφάλους, οι οποίοι κατασκευάζονται, τοποθετούνται και λειτουργούν σε θαλάσσιο χώρο της Δημοκρατίας.

(2) […] εφαρμόζονται για την αδειοδότηση δυνητικών επενδύσεων και δεν εφαρμόζονται σε σχέση με έργα τα οποία υλοποιούνται από τη Δημοκρατία».

Αποσκοπούν δηλαδή στη δημιουργία νομικού πλαισίου για την κατασκευή, τοποθέτηση και λειτουργία ιδιωτικών τεχνητών υφάλων. Σύμφωνα με το προτεινόμενο νομοσχέδιο: «Για την έκδοση ή ανανέωση άδειας κατασκευής, τοποθέτησης και λειτουργίας τεχνητών υφάλων σε θαλάσσιο χώρο καταβάλλονται τέλη που ανέρχονται σε επτακόσια ευρώ (€ 700)» (Άρθρο 7), «η άδεια χρήσης θαλάσσιου χώρου σε θαλάσσια περιοχή της Δημοκρατίας για σκοπούς κατασκευής, τοποθέτησης και λειτουργίας τεχνητών υφάλων χορηγείται από το Υπουργικό Συμβούλιο» (Άρθρο 8), και «για κάθε θαλάσσια περιοχή, σε σχέση με την οποία εκδίδεται άδεια χρήσης θαλάσσιου χώρου για σκοπούς τοποθέτησης και λειτουργίας τεχνητών υφάλων, καταβάλλονται τέλη 17 σεντ ετησίως για κάθε τετραγωνικό μέτρο της επιφάνειας του θαλάσσιου βυθού που αποτελεί τη συνολική περιοχή έκτασης των τεχνητών υφάλων, περιλαμβανομένης της θαλάσσιας περιοχής που ορίζεται με βάση το Άρθρο 5Α του Περί Αλιείας Νόμου» (Άρθρο 9).


Κατευθυντήριες Γραμμές

Σύμφωνα με ανακοίνωση που εξέδωσε ο Κυπριακός Οργανισμός Τουρισμού (ΚΟΤ) στις 2/7/2015, με αφορμή την «Εβδομάδα Ζηνοβίας», διεξήγαγε έρευνα για τη «Λειτουργία και διαχείριση των υπό δημιουργία θαλασσίων προστατευόμενων περιοχών με την τοποθέτηση τεχνητών υφάλων – θαλάσσιων πάρκων στην Κύπρο», την οποία παρέδωσε στο Τμήμα Αλιείας και Θαλασσίων Ερευνών για πιθανή αξιοποίηση. Προς συνέχεια της συγκεκριμένης έρευνας και με αφορμή τη συζήτηση του συγκεκριμένου νομοσχεδίου, σε επιστολή ημερομηνίας 24/9/2018, ο ΚΟΤ αναφέρει προς την Κοινοβουλευτική Επιτροπή Περιβάλλοντος ότι ο τομέας του καταδυτικού τουρισμού έχει μεγάλες προοπτικές ανάπτυξης και γι’αυτό τον λόγο στηρίζει την προσπάθεια που γίνεται για ρύθμιση των περιβαλλοντικών θεμάτων που αφορούν τη δημιουργία τεχνητών υφάλων.

Δεν αντιλαμβανόμαστε στη βάση ποιας δικαιοδοσίας και τεχνογνωσίας, ο ΚΟΤ προέβη σε μια έρευνα για τη «λειτουργία και διαχείριση των υπό δημιουργία θαλασσίων προστατευόμενων περιοχών με την τοποθέτηση τεχνητών υφάλων – θαλάσσιων πάρκων στην Κύπρο». Επισημαίνουμε ότι σύμφωνα με τις κατευθυντήριες αρχές του Οργανισμού Τροφίμων και Γεωργίας (Food and Agriculture Organisation – FAO) του Οργανισμού Ηνωμένων Εθνών, στόχοι των τεχνητών υφάλων είναι «η αναβάθμιση και / ή βελτίωση των φυσικών βιοτόπων, η αύξηση της παραγωγικότητας του οικοσυστήματος και η διαχείρηση των αλιευτικών πόρων» («to recover and/or improve natural habitats, increase productivity and manage aquatic resources») [1]. Επιπρόσθετα, οι κατευθυντήριες γραμμές του Μεσογειακού Σχεδίου Δράσης του Προγράμματος Περιβάλλοντος των Ηνωμένων Εθνών (United Nations Environment Programme / Mediterranean Action Plan – UNEP/MAP), αν και αναγνωρίζουν ότι οι τεχνητοί ύφαλοι μπορούν να στοχεύουν και στην προώθηση έρευνας και αναψυχής, τονίζουν πως πρωταρχικός στόχος των τεχνητών υφάλων είναι το «να παρέχουν ορισμένες λειτουργίες ενός φυσικού υφάλου, όπως η προστασία, η αναγέννηση, η συγκέντρωση και/ή η ενίσχυση της βιολογικής ποικιλομορφίας ή / και των πληθυσμών των έμβιων θαλάσσιων πόρων» («emulate some functions of a natural reef such as protecting, regenerating, concentrating, and/or enhancing [biological diversity and/or] populations of living marine resources») [2]. Σύμφωνα με το «Ερωτηματολόγιο Αντίκτυπου» του προτεινόμενου Νομοσχεδίου, ο στόχος των προτεινόμενων Κανονισμών είναι «η παραχώρηση χρήσης χώρου για τη διεξαγωγή και αδειοδότηση δυνητικών επενδύσεων με τεχνητούς υφάλους στο θαλάσσιο χώρο», γεγονός το οποίο δεν συνάδει με τις πιο πάνω κατευθυντήριες γραμμές.

Όσον αφορά τη διαβούλευση που προηγήθηκε, σε αυτή συμμετείχαν ως επί το πλείστον συναρμόδιες αρχές. Η διαβούλευση πραγματοποιήθηκε μέσω ηλεκτρονικού ταχυδρομείου, χωρίς να διεξαχθεί οποιαδήποτε δημόσια παρουσίαση και ακρόαση με τα ενδιαφερόμενα μέρη. Ο μόνος περιβαλλοντικός μη κυβερνητικός οργανισμός που κλήθηκε να υποβάλει απόψεις ήταν η Ομοσπονδία Περιβαλοντικών Οργανώσεων Κύπρου (ΟΠΟΚ), οι θέσεις της οποίας ήταν αρνητικές και δεν ενσωματώθηκαν στους προτεινόμενους Κανονισμούς.

Κατά την άποψη μας, υπάρχει έλλειψη διαφάνειας και επαρκούς αιτιολόγησης όσον αφορά τους προτεινόμενους Κανονισμούς. Σύμφωνα με το άρθρο 28 (Επαρκής Αιτιολογία) των περί Γενικών Αρχών του Διοικητικού Δικαίου Νόμων του 1999 έως 2014: «(1) Η αιτιολογία μιας διοικητικής πράξης πρέπει να είναι σαφής, ώστε να μην αφήνει αμφιβολίες ως προς το ποιος ήταν ο πραγματικός λόγος που οδήγησε το διοικητικό όργανο στη λήψη της απόφασης. (2) Δεν αποτελεί επαρκή αιτιολογία η αναφορά στην απόφαση γενικών χαρακτηρισμών που μπορούν να εφαρμοστούν και να ισχύουν για κάθε περίπτωση ούτε η απλή αναφορά των γενικών όρων του νόμου που μπορούν να τύχουν εφαρμογής σε οποιαδήποτε περίπτωση. (3) Αναιτιολόγητη είναι μια πράξη που επικαλείται γενικά και αόριστα το δημόσιο συμφέρον. Το δημόσιο συμφέρον του οποίου γίνεται επίκληση πρέπει να εξειδικεύεται με αναφορά σε συγκεκριμένα πραγματικά περιστατικά στα οποία στηρίχτηκε η κρίση του αρμόδιου διοικητικού οργάνου» [7].

Αντιλαμβανόμαστε ότι η τοποθέτηση και λειτουργία τεχνητών υφάλων από επενδυτές αποσκοπεί σε κάποια ωφελήματα στους ίδιους τους επενδυτές. Νοουμένου ότι η δημιουργία τεχνητών υφάλων έχει πολύ υψηλό οικονομικό κόστος, ποιά θα είναι τα ωφελήματα και με ποιό τρόπο θα γίνει η απόσβεση ενός ιδιώτη επενδυτή;

Ταυτόχρονα η εκχώρηση δημόσιου (θαλάσσιου) χώρου ενέχει και άλλους προβληματισμούς και ερωτήματα τα οποία δεν έχουν απαντηθεί. Τι είδους δικαιώματα αποκτά ένας ιδιώτης επενδυτής, ο οποίος ενδέχεται να υποβάλει αίτηση για χορήγηση άδειας κατασκευής, τοποθέτησης και λειτουργίας τεχνητού υφάλου στο θαλάσσιο χώρο της Κυπριακής Δημοκρατίας, με βάση τους προτεινόμενους Κανονισμούς; Στη βάση ποιων κριτηρίων και προδιαγραφών θα γίνεται η επιλογή του θαλάσσιου χώρου στον οποίο θα κατασκευαστεί ένας τεχνητός ύφαλος;

Πέρα από την ασυμβατότητα των προτεινόμενων Κανονισμών με τις Κατευθυντήριες Γραμμές Διεθνών Οργανισμών, όπως ο FAO και το UNEP/MAP, θα θέλαμε να σημειώσουμε και τους προβληματισμούς μας σχετικά με την ευθυγράμμιση / εναρμόνιση του συγκεκριμένου Νομοσχεδίου, με άλλες υποχρεώσεις της Κυπριακής Δημοκρατίας, και συγκεκριμένα τη θέσπιση ενός δικτύου Θαλάσσιων Προστατευόμενων Περιοχών, καθώς και την εκπόνηση ενός Θαλάσσιου Χωροταξικού Σχεδιασμού.


Θαλάσσιες Προστατευόμενες Περιοχές

Το συγκεκριμένο νομοσχέδιο προωθείται με το πρόσχημα ότι οι τεχνητοί ύφαλοι θα «συμβάλλουν στην ανάπτυξη της βιοποικιλότητας, στην ανάκαμψη των ιχθυοαποθεμάτων και στην προσέλκυση καταδυτικού τουρισμού» (Άρθρο2: «Ερμηνεία»).

Το Τμήμα Αλιείας και Θαλασσίων Ερευνών (ΤΑΘΕ) του Υπουργείου Γεωργίας, Φυσικών Πόρων και Περιβάλλοντος, έχει από το 2012 θεσπίσει, και ξεκινήσει να εφαρμόζει σχετική στρατηγική για τη δημιουργία θαλάσσιων προστατευόμενων περιοχών με τεχνητούς υφάλους. Έχουν ήδη εκδοθεί 6 διατάγματα για απαγόρευση αλιείας και διέλευσης σκαφών σε καθορισμένες θαλάσσιες περιοχές, με βάση το Άρθρο 5Α («Έκδοση διατάγματος απαγόρευσης της αλιείας ή/και της διέλευσης σκαφών») του «Περι Αλιείας Νόμο (ΚΕΦ.135)» [3]. Τα διατάγματα αυτά αφορούν τις ακόλουθες περιοχές: Θαλάσσια Προστατευόμενη Περιοχή Παραλιμνίου [4], Θαλάσσια Περιοχή Τεχνητού Υφάλου στην Αγία Νάπα [5], Ναυάγιο Ζηνοβία στη Λάρνακα [6], Θαλάσσια Προστατευόμενη Περιοχή Αμαθούντας στην Λεμεσό [7], Θαλάσσια Προστατευόμενη Περιοχή στο Δασούδι στην Λεμεσό [8] και Θαλάσσια Προστατευόμενη Περιοχή Τεχνητού Υφάλου Γεροσκήπου στην Πάφο [9].

Σύμφωνα με την Ειδική Έκθεση της Ελεγκτικής Υπηρεσίας της Κυπριακής Δημοκρατίας για τη «Διαχείριση Θαλάσσιων Προστατευόμενων Περιοχών στην Κύπρο», η «απουσία ενιαίας εθνικής στρατηγικής στην Κύπρο για τη διαχείριση των θαλάσσιων προστατευόμενων περιοχών και ο καταρτισμός επιμέρους στρατηγικών εγγράφων ενδεχομένως να οδηγεί σε κατακερματισμό των προσπαθειών της Δημοκρατίας για την προστασία των περιοχών και των ειδών και οικοτόπων που απαντώνται σε αυτές» [10]. Η Ειδική Έκθεση επίσης αναφέρει ότι «διαπιστώνονται ανεπάρκειες στους μηχανισμούς παρακολούθησης της κατάστασης των προστατευόμενων περιοχών με τεχνητούς υφάλους, ενώ ο βαθμός εφαρμογής των καθορισμένων μέτρων διαχείρισης και η αποτελεσματικότητά τους στη διατήρηση των προστατευόμενων ειδών και περιοχών, δεν φαίνεται να αξιολογούνται» [11].

Το συγκεκριμένο νομοσχέδιο δεν θα βοηθήσει ως προς την εφαρμογή μιας ενιαίας εθνικής στρατηγικής για θαλάσσιες προστατευόμενες περιοχές στην Κύπρο, η οποία πρέπει να έχει προτεραιότητα. Αντίθετα, θα αποτελέσει ένα επιπλέον εμπόδιο, καθώς αντί να κηρύσσονται θαλάσσιες προστατευόμενες περιοχές με βάση οικολογικά κριτήρια, θα δημιουργούνται στη βάση ιδιωτικών συμφερόντων και επενδυτικών προγραμμάτων.


Θαλάσσιος Χωροταξικός Σχεδιασμός

Το συγκεκριμένο νομοσχέδιο προωθείται ενώ αναμένεται να ολοκληρωθεί ο Θαλάσσιος Χωροταξικός Σχεδιασμός (ΘΧΣ – Maritime Spatial Planning, MSP), ένα από τα βασικά εργαλεία της Ολοκληρωμένης Θαλάσσιας Πολιτικής της Ευρωπαϊκής Ένωσης. Σύμφωνα με την Γενική Διεύθυνση Περιβάλλοντος της Ευρωπαϊκής Επιτροπής, με την έννοια του ΘΧΣ υποδηλώνεται «ο σχεδιασμός του χρόνου και του τόπου άσκησης ανθρώπινων δραστηριοτήτων στη θάλασσα, προκειμένου να διασφαλίζεται η αποτελεσματικότητα και η βιωσιμότητά τους στον μέγιστο δυνατό βαθμό. Κατά τη διαδικασία αυτή, όλα τα ενδιαφερόμενα μέρη συνεργάζονται με διαφάνεια με στόχο τον σχεδιασμό των θαλάσσιων δραστηριοτήτων» [12]. Η Κυπριακή Δημοκρατία εναρμονίστηκε με την Οδηγία 2014/89/ΕΕ του Ευρωπαϊκού Κοινοβουλίου και του Συμβουλίου της 23ης Ιουλίου 2014 Περί Θεσπίσεως Πλαισίου για τον Θαλάσσιο Χωροταξικό Σχεδιασμό με την ψήφιση από την Βουλή των Αντιπροσώπων του περί Θαλάσσιου Χωροταξικού Σχεδιασμού και άλλων Συναφών Θεμάτων Νόμου του 2017 [Ν. 144(I)/2017] [13] στις 29/9/2017 και τη δημοσίευση του στην Επίσημη Εφημερίδα της Δημοκρατίας στις 13/10/2017.

Σύμφωνα με το Άρθρο 2 του σχετικού Νόμου, «Θαλάσσιο Χωροταξικό Σχέδιο» σημαίνει το «εθνικό σχέδιο ή σχέδια που καταρτίζονται, εγκρίνονται και δημοσιεύονται ως αποτέλεσμα της διαδικασίας του θαλάσσιου χωροταξικού σχεδιασμού» («Ερμηνεία»). Επιπρόσθετα, σύμφωνα με το Άρθρο 17(2) («Κατάρτιση του Θαλάσσιου Χωροταξικού Σχεδίου»), η θέσπιση του Θαλάσσιου Χωροταξικού Σχεδίου «θα πρέπει να καταρτιστεί το συντομότερο δυνατό και το αργότερο έως την 31η Μαρτίου 2021».

Σημειώνεται ότι στις 25/10/2017 και ενώ η Ευρωπαϊκή Επιτροπή είχε ανοίξει υπόθεση παράβασης του κοινοτικού κεκτημένου, η οποία βρισκόταν σε επίπεδο Αιτιολογημένης Γνώμης, για μη εναρμόνιση με την σχετική Οδηγία [14], το Υπουργικό Συμβούλιο ενέκρινε και εξουσιοδότησε τον Υπουργό Γεωργίας, Αγροτικής Ανάπτυξης και Περιβάλλοντος όπως καταθέσει τους προτεινόμενους Κανονισμούς στη Βουλή των Αντιπροσώπων για έγκριση.

Η ψήφιση των προτεινόμενων Κανονισμών από την Βουλή των Αντιπροσώπων και η προώθηση επενδύσεων υπό μορφή ιδιωτικών τεχνητών υφάλων θα δημιουργήσει τετελεσμένα εν τω μέσω της διαδικασίας κατάρτισης του θαλάσσιου χωροταξικού σχεδιασμού.



Έχοντας ως γνώμονα το γεγονός ότι η θάλασσα αποτελεί κοινό αγαθό και δημόσιο πλούτο, θεωρούμε ότι σε κρατική ακίνητη ιδιοκτησία πρέπει να αδειοδοτούνται αποκλειστικά σχέδια, προγράμματα ή/και έργα, τα οποία εξυπηρετούν υπέρτερους λόγους σημαντικού δημοσίου συμφέροντος και αιτιολογούνται επαρκώς, με αναφορά σε συγκεκριμένα πραγματικά περιστατικά. Προτεραιότητα της Κυπριακής Δημοκρατίας θα πρέπει να είναι μια Ολοκληρωμένη Θαλάσσια Πολιτική βασισμένη σε οικολογικά πρωτίστως κριτήρια, αλλά και κοινωνικά, και όχι σε δυνητικές επενδύσεις οι οποίες θα οικειοποιηθούν δημόσιο πλούτο για παραγωγή κέρδους από ιδιώτες επενδυτές.

Η οικειοποίηση και αποξένωση των κοινών αγαθών – της γης, των δασών, των παραλιών, της ακτογραμμής και της θάλασσας – δεν νομιμοποιείται ηθικά, κοινωνικά και πολιτικά. Στη βάση των πιο πάνω, η Πρωτοβουλία για τη Διάσωση των Φυσικών Ακτών  διαφωνεί με τους υπό συζήτηση Κανονισμούς και εισηγείται την απόσυρση τους από το Υπουργείο Γεωργίας, Αγροτικής Ανάπτυξης και Περιβάλλοντος ή την καταψήφιση τους από την Κοινοβουλευτική Επιτροπή Περιβάλλοντος και την Ολομέλεια της Βουλής των Αντιπροσώπων.

Σημείωμα Θέσεων – Τετάρτη, 3 Απριλίου 2019

Προς: Πρόεδρο και Μέλη Κοινοβουλευτικής Επιτροπής Περιβάλλοντος

Θέμα: Η επέμβαση του Τμήματος Δασών στις προστατευόμενες παραλίες ωοτοκίας των θαλάσσιων χελωνών της Λίμνης και της Αργάκας στον Κόλπο Χρυσοχούς και οι επιπτώσεις στο φυσικό περιβάλλον της περιοχής (Αυτεπάγγελτη εξέταση έπειτα από απόφαση της Κοινοβουλευτικής Επιτροπής Περιβάλλοντος και του κ. Γιώργου Περδίκη, 27/3/2019, Αρ. Φακ.

  1. Το «Διαχειριστικό Σχέδιο της Ειδικής Ζώνης Διατήρησης Περιοχή Πόλις – Γιαλιά (CY4000001)» προνοεί τη σταδιακή απομάκρυνση του χωροκατακτητικού ξένου είδους της ακακίας (Acacia saligna) από την περιοχή Natura 2000, την αντικατάσταση του με ιθαγενή είδη χλωρίδας και την αποκατάσταση των αμμοθινικών οικοτόπων. Η συγκεκριμένη δράση αποσκοπεί πρωτίστως στην προστασία των ενδημικών, σπάνιων και απειλούμενων ειδών που περιλαμβάνονται στο «Κόκκινο Βιβλίο της Χλωρίδας της Κύπρου» και απειλούνται από την επέκταση της ακακίας. Επιπλέον, το Διαχειριστικό Σχέδιο προβλέπει την εκ των προτέρων εκπόνηση και αξιολόγηση κατάλληλης φυτοτεχνικής μελέτης και σχεδίου εφαρμογής φυτεύσεων με ιθαγενή είδη βλάστησης, λαμβάνοντας υπόψη πάντοτε το ρόλο που επιτελεί η πυκνή και απροσπέλαστη βλάστηση από ακακίες στην προστασία των παραλιών ωοτοκίας του είδους προτεραιότητας της θαλάσσιας χελώνας Caretta caretta από τη φωτορύπανση, την ηχορύπανση, την ανθρώπινη όχληση και την πρόσβαση οχημάτων.


  1. Λαμβάνοντας υπόψη το χρόνο, το χώρο, τη διαδικασία, την κλίμακα και τη μέθοδο των εργασιών απομάκρυνσης της ακακίας που διεξήγαγε το Τμήμα Δασών στην παραλία της Λίμνης Πόλις Χρυσοχούς και το δυτικό μέρος της παραλίας της Αργάκας, εντός του Κρατικού Δάσους Μαυραλής και της Ειδικής Ζώνης Διατήρησης Περιοχή Πόλις – Γιαλιά (CY4000001), θεωρούμε ότι οι εργασίες αυτές δεν συνάδουν με τις προβλεπόμενες ρυθμίσεις του Διαχειριστικού Σχεδίου για την περιοχή Natura Τονίζεται ότι οι εργασίες απομάκρυνσης της ακακίας πραγματοποιήθηκαν ενάμισι μήνα πριν από την έναρξη της αναπαραγωγικής περιόδου (αρχές Μαΐου) της θαλάσσιας χελώνας Caretta caretta, η οποία αποτελεί το κύριο είδος καθορισμού και προτεραιότητας της περιοχής Natura 2000. Παράλληλα, αντί της σταδιακής απομάκρυνσης της ακακίας, η εκχέρσωση και η πλήρης αποκοπή των ακακιών σε έκταση συνολικού μήκους περίπου 700 μέτρων και μέσου πλάτους περίπου 25 μέτρων, αφήνει εντελώς εκτεθειμένη τη σημαντικότερη σε πυκνότητα φωλεοποίησης παραλία ωοτοκίας του είδους προτεραιότητας της θαλάσσιας χελώνας Caretta caretta στην Κυπριακή Δημοκρατία και μία εκ των σημαντικότερων στη Μεσόγειο και την Ευρωπαϊκή Ένωση.


  1. Επισημαίνεται ότι εντός της Ειδικής Ζώνης Διατήρησης Περιοχή Πόλις – Γιαλιά (CY4000001), συνολικού μήκους περίπου 11 χιλιομέτρων, απαντώνται 5 σπάνια και απειλούμενα, αμμόφιλα είδη που περιλαμβάνονται στο «Κόκκινο Βιβλίο της Χλωρίδας της Κύπρου»:
    • Το ενδημικό και κρισίμως κινδυνεύον Malcolmia nana var glabra: Στην 95η συνεδρίαση της Επιστημονικής Επιτροπής, η οποία έγινε στις 31/7/2017, το Τμήμα Δασών ενημέρωσε την Επιστημονική Επιτροπή ότι θα προβεί στην υλοποίηση μίας εντός τόπου (in situ) δράσης διατήρησης του είδους, στο πλαίσιο του έργου CARE-MEDIFLORA («Δράσεις Διατήρησης Απειλούμενων Φυτικών Ειδών των Νησιών της Μεσογείου: Κοινές δράσεις για εκτός τόπου και εντός τόπου διατήρηση»). Η δράση διατήρησης αποσκοπούσε στην ενίσχυση του πληθυσμού του είδους και την απομάκρυνση της ακακίας από τη θέση στην οποία εντοπίζεται στο Κρατικό Δάσος Γιαλιάς. Η θέση αυτή απέχει περίπου 5 χιλιομέτρα από το ανατολικό άκρο του Κρατικού Δάσους Μαυραλής και 6 χιλιόμετρα από το ανατολικό άκρο της παραλίας της Λίμνης.
    • Το κινδυνεύον Ipomoea imperati: Πρόκειται για το μοναδικό σπάνιο και απειλούμενο είδος χλωρίδας που βρίσκεται στο Κρατικό Δάσος Μαυραλής. Ωστόσο, η θέση στην οποία εντοπίζεται βρίσκεται σε απόσταση περίπου 350 μέτρων από το ανατολικό άκρο της παραλίας της Λίμνης και εκτός της περιοχής εκχέρσωσης και αποκοπής των ακακιών. Επιπλέον, η επέκταση της ακακίας δεν συνιστά απειλή για το ενδιαίτημα του είδους (παράκτιες αμμώδεις και αμμοχαλικώδεις θέσεις).
    • Το εύτρωτο Achillea maritima: Το είδος βρίσκεται σε απόσταση περίπου 4 χιλιομέτρων από το ανατολικό άκρο του Κρατικού Δάσους Μαυραλής και 6 χιλιομέτρων από το ανατολικό άκρο της παραλίας της Λίμνης.
    • Το εύτρωτο Mesembryanthemum crystallinum: Το είδος βρίσκεται σε απόσταση περίπου 5,5 χιλιομέτρων από το ανατολικό άκρο του Κρατικού Δάσους Μαυραλής και 6,5 χιλιομέτρων από το ανατολικό άκρο της παραλίας της Λίμνης.
    • Το εγγύς απειλούμενο Pancratium maritimum: Το είδος βρίσκεται σε απόσταση περίπου 3,5 χιλιομέτρων από το ανατολικό άκρο του Κρατικού Δάσους Μαυραλής και 4,5 χιλιομέτρων από το ανατολικό άκρο της παραλίας της Λίμνης.

Στη βάση των πιο πάνω, η ακακία στο Κρατικό Δάσος Μαυραλής δεν αποτελούσε σοβαρή απειλή για οποιοδήποτε ενδημικό, σπάνιο και απειλούμενο είδος που περιλαμβάνεται στο «Κόκκινο Βιβλίο της Χλωρίδας της Κύπρου».


  1. Σημειώνεται ότι τον Σεπτέμβριο 2012, υπεργολάβος ιδιωτικής εταιρείας επενέβη παράνομα σε μέρος της κρατικής δασικής γης, ξερίζωσε ακακίες και εκχέρσωσε έκταση συνολικής έκτασης περίπου 600 τ.μ. Σύμφωνα με το ίδιο το Τμήμα Δασών, η παράνομη επέμβαση στην παραλία της Λίμνης Πόλις Χρυσοχούς προέκυψε αρχικά «με την ανοχή των δασικών υπαλλήλων λόγω κακής συνεννόησης και στη συνέχεια χωρίς αυτήν». Αμέσως υπήρξε αντίδραση από το Τμήμα Δασών, ο υπεργολάβος καταγγέλθηκε, διατάχθηκε πειθαρχική έρευνα και οι εργασίες καθαρισμού ολοκληρώθηκαν από το Τμήμα Δασών στην ίδια έκταση. Σε συγκριτική οπτική:
    • Η παράνομη επέμβαση που πραγματοποιήθηκε τον Σεπτέμβριο 2012 οδήγησε στην εκχέρσωση έκτασης συνολικού μήκους περίπου 150 μέτρων, ενώ η επέμβαση του Τμήματος Δασών που έγινε τον Μάρτιο 2019 οδήγησε στην εκχέρσωση έκτασης συνολικού μήκους περίπου 700 μέτρων.
    • Η παράνομη επέμβαση που πραγματοποιήθηκε τον Σεπτέμβριο 2012 συνέπεσε με το τέλος της αναπαραγωγικής περιόδου των θαλάσσιων χελώνων, ενώ η επέμβαση του Τμήματος Δασών τον Μάρτιο 2019 έγινε αμέσως πριν από την έναρξη της αναπαραγωγικής περιόδου των θαλάσσιων χελώνων.
    • Η παράνομη επέμβαση που πραγματοποιήθηκε τον Σεπτέμβριο 2012 επηρέασε μία μικρή περιοχή εκτός της ζώνης φωλεοποίησης των θαλάσσιων χελώνων και πλησίον της αποβάθρας και των αποθηκών του παλαιού μεταλλείου της Λίμνης, ενώ η επέμβαση του Τμήματος Δασών που έγινε τον Μάρτιο 2019 επηρεάζει ολόκληρη την παραλία της Λίμνης και το δυτικό μέρος της παραλίας της Αργάκας, δηλαδή ένα πολύ μεγάλο μέρος της ζώνης φωλεοποίησης των θαλάσσιων χελώνων.
    • Οι επιπτώσεις της παράνομης επέμβασης που πραγματοποιήθηκε τον Σεπτέμβριο 2012 κρίθηκαν ως ήπιες, επειδή θεωρήθηκε ότι οι μικρές αποθήκες του παλαιού μεταλλείου της Λίμνης που βρίσκονται ανατολικά της αποβάθρας μπορούσαν να προστατεύσουν την παραλία ωοτοκίας από τη φωτορύπανση, σε συνδυασμό με το προστατευτικό δίχτυ που τοποθετήθηκε πίσω από αυτές. Λόγω του γεγονότος ότι η επέμβαση του Τμήματος Δασών που έγινε τον Μάρτιο 2019 αφήνει απροστάτευτη ολόκληρη την παραλία της Λίμνης και το δυτικό μέρος της παραλίας της Αργάκας από τη φωτορύπανση που προκαλείται από τα διερχόμενα αυτοκίνητα του παρακείμενου δρόμου Πόλις Χρυσοχούς – Αργάκας και τις οικοδομές που βρίσκονται εκατέρωθεν του συγκεκριμένου δρόμου, οι επιπτώσεις δεν μπορούν να θεωρηθούν ως ήπιες.


  1. Σύμφωνα με το άρθρο 15 (Διάταγμα διαχείρισης και προστασίας της φύσης) του περί Προστασίας και Διαχείρισης της Φύσης και της Άγριας Ζωής Νόμου του 2003 έως 2015, ο οποίος εναρμονίζει τη νομοθεσία της Κυπριακής Δημοκρατίας με την Οδηγία 92/43/ΕΟΚ του Συμβουλίου της 21ης Μαΐου 1992 για τη διατήρηση των φυσικών οικοτόπων καθώς και της άγριας πανίδας και χλωρίδας, για τον καθορισμό συγκεκριμένων μέτρων διατήρησης και σχεδίων διαχείρισης χρειάζεται η γραπτή γνωμοδότηση της Επιστημονικής Επιτροπής, αφού ληφθούν υπόψη οι θέσεις των συναρμόδιων αρχών, και η έκδοση σχετικού διατάγματος από τον Υπουργό Γεωργίας, Αγροτικής Ανάπτυξης και Περιβάλλοντος. Στην προκειμένη περίπτωση, δεν υποβλήθηκε γραπτή γνωμοδότηση της Επιστημονικής Επιτροπής και δεν εκδόθηκε σχετικό Διάταγμα Διαχείρισης και Προστασίας της Φύσης για την Ειδική Ζώνη Διατήρησης Περιοχή Πόλις – Γιαλιά (CY4000001) από τον Υπουργό Γεωργίας, Αγροτικής Ανάπτυξης και Περιβάλλοντος. Επιπρόσθετα, το Τμήμα Δασών δεν προέβη στην ενημέρωση των συναρμόδιων αρχών (Τμήμα Περιβάλλοντος και Τμήμα Αλιείας και Θαλάσσιων Ερευνών) και της Επιστημονικής Επιτροπής (παρά τις σχετικές διαβεβαιώσεις που δόθηκαν από το Τμήμα Δασών στη συνεδρίαση με αριθμό 95 και ημερομηνία 31/7/2017, οπότε έγινε παρουσίαση των δράσεων του έργου CARE-MEDIFLORA και εγκρίθηκε μία μικρότερης κλίμακας, εντός τόπου δράση διατήρησης στο Κρατικό Δάσος Γιαλιάς).


  1. Η επηρεαζόμενη έκταση στην παραλία της Λίμνης Πόλις Χρυσοχούς και το δυτικό μέρος της παραλίας της Αργάκας, εντός του Κρατικού Δάσους Μαυραλής και της Ειδικής Ζώνης Διατήρησης Περιοχή Πόλις – Γιαλιά (CY4000001), έχει συνολικό μήκος περίπου 700 μέτρα και μέσο πλάτος περίπου 25 μέτρα. Συνεπώς, δεν πρόκειται περί μίας αμελητέας επέμβασης μικρής κλίμακας και ήσσονος σημασίας. Επιπλέον, η απομάκρυνση της βλάστησης έγινε ενάμισι μήνα πριν την έναρξη της αναπαραγωγικής περιόδου και αφήνει εκτεθειμένη τη σημαντικότερη σε πυκνότητα φωλεοποίησης παραλία ωοτοκίας του είδους προτεραιότητας της θαλάσσιας χελώνας Caretta caretta. Λόγω ακριβώς της ευνοϊκής κατάστασης διατήρησης του βιοτόπου του κύριου είδους καθορισμού και προτεραιότητας της Ειδικής Ζώνης Διατήρησης Περιοχή Πόλις – Γιαλιά (CY4000001), θεωρούμε ότι μία τέτοια ενέργεια δεν ήταν αναγκαία για τη διαχείριση της εν λόγω περιοχής, καθώς η ακακία δεν αποτελούσε σοβαρή απειλή για αμμοθινικούς οικοτόπους προτεραιότητας ή/και ενδημικά, σπάνια και απειλούμενα είδη χλωρίδας. Παράλληλα, η επέμβαση αυτή ενδέχεται να επιφέρει σοβαρές, αρνητικές και μακροπρόθεσμες επιπτώσεις στο κύριο είδος καθορισμού και προτεραιότητας της θαλάσσιας χελώνας Caretta caretta και τους στόχους διατήρησης της περιοχής Natura 2000. Όπως αναφέρεται στη Γνωμάτευση Μελέτης Εκτίμησης Επιπτώσεων στο Περιβάλλον για την διαχείριση αποβλήτων από τις εγκαταστάσεις του παλαιού μεταλλείου της Λίμνης, η οποία εκδόθηκε στις 6/11/2009, «στην παραλία όπου έχουν γίνει μεταλλευτικές αποθέσεις καταγράφεται η πυκνότερη φωλεοποίηση της Caretta caretta στην Κύπρο. Οποιαδήποτε επέμβαση δεν θα προκαλέσει αναβάθμιση του βιοτόπου, αλλά αντίθετα θα έχει σοβαρές και μη αναστρέψιμες επιπτώσεις, με αποτέλεσμα την απώλεια ενός πολύ σημαντικού ενδιαιτήματος ωοτοκίας ενός είδους που κινδυνεύει με αφανισμό και που είναι είδος προτεραιότητας της ΕΕ. Ως εκ τούτου, απαγορεύεται η οποιαδήποτε επέμβαση ή ενέργεια στην περιοχή αυτή». Ειδικότερα, θεωρούμε ότι η εκχέρσωση της κρατικής δασικής γης που αποτελείτο από πυκνή και απροσπέλαστη βλάστηση ακακιών με τη χρήση μηχανικών μέσων (εκσκαφέων) και η καύση μεγάλων σωρών ακακιών πάνω στους αμμόλοφους έχει οδηγήσει στη διατάραξη, υποβάθμιση και αλλοίωση του ενδιαιτήματος του είδους καθορισμού και προτεραιότητας της θαλάσσιας χελώνας Caretta caretta. Τονίζουμε ότι η καταπάτηση των αμμοθινικών οικοτόπων από βαρέα μηχανοκίνητα οχήματα προκαλεί συμπίεση του εδάφους, με αποτέλεσμα τα θηλυκά άτομα θαλάσσιων χελώνων να μην μπορούν να σκάψουν τις φωλιές τους και να γεννήσουν τα αβγά τους πάνω στους αμμόλοφους. Επιπλέον, οι μεγάλες σωροί στάχτης που έχουν δημιουργηθεί από την καύση ακακιών και τα ιζήματα (μεταλλευτικές αποθέσεις) του παλαιού μεταλλείου της Λίμνης ενδέχεται να μεταφερθούν πάνω στους αμμόλοφους και την αμμώδη παραλία, κυρίως λόγω των έντονων βροχοπτώσεων των τελευταίων ημερών, και να επηρεάσουν τη σύσταση του εδάφους. Επιπλέον, η αφαίρεση της πυκνής και απροσπέλαστης βλάστησης με ακακίες μεγιστοποιεί τον κίνδυνο φωτορύπανσης, ηχορύπανσης, ανθρώπινης όχλησης και ανεξέλεγκτης πρόσβασης μηχανοκίνητων οχημάτων στο βιότοπο ζωτικής σημασίας του κύριου είδους καθορισμού και προτεραιότητας της θαλάσσιας χελώνας Caretta caretta.


  1. Κατά την άποψη μας, η αφαίρεση με μηχανικά μέσα της πυκνής και απροσπέλαστης βλάστησης με ακακίες από την παραλία της Λίμνης Πόλις Χρυσοχούς και το δυτικό μέρος της παραλίας της Αργάκας από το Τμήμα Δασών συνιστά παράβαση ουσιωδών όρων της περιβαλλοντικής έγκρισης που εξέδωσε η Περιβαλλοντική Αρχή για την ανέγερση δύο γηπέδων γκολφ με παρεμφερείς εμπορικές, τουριστικές και οικιστικές αναπτύξεις στην περιοχή της Λίμνης Πόλις Χρυσοχούς (βλ. Έκθεση Δέουσας Εκτίμησης Επιπτώσεων στο Περιβάλλον, ημερομηνίας 25/6/2016, και Γνωματεύσεις Μελετών Εκτίμησης Επιπτώσεων στο Περιβάλλον, ημερομηνίας 2/8/2016 και 18/5/2018). Οι ουσιώδεις όροι της περιβαλλοντικής έγκρισης και των σχετικών πολεοδομικών αδειών που φαίνεται να παραβιάζονται αφορούν την απαγόρευση της πρόσβασης οποιουδήποτε οχήματος και γενικά οποιασδήποτε επέμβασης σε οποιοδήποτε τμήμα της παράκτιας ζώνης, τη διατήρηση των υφιστάμενων δέντρων και της αυτοφυούς βλάστησης, τη δημιουργία πυκνής βλάστησης ύψους 4 μέτρων πίσω από τους αμμοθινικούς οικότοπους για την αποφυγή οποιουδήποτε φωτισμού που εκπέμπεται προς την παραλία και τη διασφάλιση της απομόνωσης της εν λόγω περιοχής. Επιπρόσθετα, κατά την άποψη μας, η αφαίρεση του φυτοφράκτη ακακιών συνιστά παράβαση των μέτρων προτεραιότητας που έχουν καθορισθεί με βάση τα Διατάγματα Κήρυξης (Κ.Δ.Π. 231/2017 και 233/2017) της Ειδικής Ζώνης Διατήρησης Περιοχή Πόλις – Γιαλιά (CY4000001), τα οποία αφορούν τη διατήρηση και βελτίωση της κατάστασης διατήρησης του είδους προτεραιότητας της θαλάσσιας χελώνας Caretta caretta, καθώς και τον περιορισμό και την απαγόρευση ενεργειών και δραστηριοτήτων εντός της περιοχής Natura 2000 που δυνατό να έχουν σημαντικές αρνητικές επιπτώσεις στα αντικείμενα προστασίας, λόγω της υποβάθμισης των οικοτόπων και της όχλησης των ειδών καθορισμού της εν λόγω περιοχής.


  1. Στη βάση των πιο πάνω, θεωρούμε ότι η επέμβαση του Τμήματος Δασών καταστρατηγεί την θεμελιώδη αρχή της πρόληψης και της προφύλαξης (prevention and precautionary principle). Όπως επισημαίνει ο ειδικός εμπειρογνώμονας της Μόνιμης Επιτροπής της Σύμβασης της Βέρνης για τη Διατήρηση της Ευρωπαϊκής Άγριας Ζωής και των Φυσικών Οικοτόπων του Συμβουλίου της Ευρώπης, Δρ. Paolo Casale, ο οποίος εκπόνησε έκθεση αξιολόγησης για τη διατήρηση των παραλιών ωοτοκίας των θαλάσσσιων χελώνων στις περιοχές Natura 2000 Τόπος Κοινοτικής Σημασίας Χερσόνησος Ακάμας (CY4000010) και Ειδική Ζώνη Διατήρησης Περιοχή Πόλις – Γιαλιά (CY4000001), κατόπιν επιτόπιας επίσκεψης που πραγματοποίησε τον Οκτώβριο 2016: «Μέσα από το διάλογο, φαίνεται ότι έχει προκληθεί σύγχυση / παρερμηνεία δύο διαφορετικών εννοιών: της προσέγγισης της προφύλαξης (precautionary approach) και των μέτρων μετριασμού (mitigation measures). Τα μέτρα μετριασμού είναι εκείνα τα μέτρα που αποσκοπούν στη μείωση των επιπτώσεων μίας ανθρωπογενούς απειλής, η οποία υφίσταται ήδη και έχει αρνητικές επιπτώσεις στον πληθυσμό. Σε μία τέτοια περίπτωση, η μείωση στον ελάχιστο δυνατό βαθμό της απειλής αποτελεί τη μέγιστη δυνατή επιδίωξη των μέτρων μετριασμού, αλλά η πλήρης αποτροπή της απειλής – π.χ. η αποκατάσταση των φυσικών συνθηκών ενός ενδιαιτήματος – ενδέχεται να μην είναι ρεαλιστική. Από την άλλη πλευρά, σε μία φυσική κατάσταση, δηλαδή χωρίς να υφίσταται ήδη μία συγκεκριμένη ανθρωπογενής απειλή, και στο πλαίσιο της επιστημονικής αβεβαιότητας σχετικά με τις επιπτώσεις μίας δυνητικής απειλής, λόγω της πολυπλοκότητας των σχετικών παραγόντων, η προσέγγιση της προφύλαξης προϋποθέτει την αποφυγή της πρόκλησης μίας πιθανής απειλής σε ένα τόσο σημαντικό και ευαίσθητο ενδιαίτημα, όπως μία παραλία ωοτοκίας θαλάσσιων χελώνων. Η τελευταία περίπτωση περιγράφει την υφιστάμενη κατάσταση στην Λίμνη». Σύμφωνα με τον ειδικό εμπειρογνώμονα της Σύμβασης της Βέρνης και Επικεφαλή της Εξειδικευμένης Ομάδας για τις Θαλάσσιες Χελώνες της Επιτροπής Επιβίωσης Ειδών της Διεθνούς Ένωσης για τη Διατήρηση της Φύσης: «Η πρόκληση μίας τέτοιας δυνητικής απειλής σε μία φυσική κατάσταση και η προσπάθεια αντιστάθμισης της στη συνέχεια, μέσω της επιβολής μέτρων μετριασμού, είναι μία προσέγγιση θεωρητικά αμφισβητούμενη και αδύνατη», καθώς «λόγω της πολυπλοκότητας των σχετικών παραγόντων, ενδέχεται να έχει επιπρόσθετες επιπτώσεις τις οποίες είναι δύσκολο ακόμη και να φανταστούμε προς το παρόν στάδιο».

During our action week some of our friends decided to occupy hotels which during the corona pandemic are empty in order to show that there is plenty of room for everyone in Europe. Here is a small collection:


Öffnet die Hotels – Evcuate Moria – Shutdown Capitalism!Heute Montag haben Aktivist*innen ein Transparent auf dem Wiener Hotel Intercontinental befestigt, um darauf aufmerksam zu machen, dass während hunderte Hotels ungenutzt leer stehen, tausende Geflüchtete in Lagern auf den griechischen Inseln leben müssen. Die auch ansonsten schon äußerst prekäre Situation in diesen Lagern wird durch die drohende Gefahr eines Ausbruchs des Coronavirus noch massiv verschärft. Verantwortlich dafür ist die seit Jahren menschenverachtende Grenzpolitik der Europäischen Union und ihrer Mitgliedsstaaten, ganz wesentlich gestützt und vorangetrieben von der österreichischen Regierung um Bundeskanzler Kurz.„Während in Österreich Corona-Schutzmaßnahmen fortgesetzt werden, leben 40 000 Menschen in maßlos überbelegten Lagern auf den ägäischen Inseln, festgehalten an den EU-Außengrenzen noch bevor sie das europäische Festland erreichen konnten. Ihr Elend ist politisch verursacht und gewollt, es soll zur Abschreckung dienen“, sagt Carla Sedlak, Pressesprecherin der Plattform Radikale Linke. Dieses Missverhältnis zeigt deutlich, wie auch unter der Maßgabe des „Seuchenschutzes“ weiterhin zwischen schützenwertem und nicht-schützenswertem Leben unterschieden wird.Die mehr als 20 000 Menschen, die in der Hölle von Moria auf Lesbos zusammengedrängt ausharren müssen, sind zum Symbol dieser Katastrophe geworden. Das Lager ist höchstens auf 3 000 Bewohner*innen ausgelegt. Sanitäre Einrichtungen, Desinfektionsmittel und ärztliche Versorgung gibt es kaum, Wasser ist nur begrenzt vorhanden, die Infrastruktur steht kurz vor dem Kollaps. Angesichts der Gefahr eines Corona-Ausbruchs entwickelt sich das Lager nun für die vor Krieg und Gewalt Geflohenen zur Todesfalle. Abstand wahren oder das Einhalten anderer Vorsichtsmaßnahmen ist schlicht unmöglich. „Die AUA holt mit hohem finanziellen Aufwand Österreicher*innen aus aller Welt zurück, ansonsten werden möglichst billige Arbeitskräfte für das österreichische Pflegesystem und die Landwirtschaft eingeflogen. Die Aufnahme von Geflüchteten aus den höchst prekären Lagern an den europäischen Außengrenzen wird nicht einmal mehr öffentlich diskutiert“, zeigt sich Sedlak empört und fährt fort: „Die viel gepriesene „Solidarität“ endet also an der nationalen Grenze – was dazu führt, dass sie keine Solidarität im eigentlichen Sinne ist.“Die Aktivist*innen fordern die sofortige Evakuierung des Lagers Moria und die Aufnahme von schutzsuchenden Menschen in den leerstehenden Hotels. Des Weiteren fordern sie die Schließung aller Lager, die Freilassung aller Personen in Schubhaft und die Abschaffung des mörderischen EU-Grenzregimes. „Vor der Zukunft haben alle Angst. Sie wird durch Abschiebungen verstärkt, durch das Elend hinter dem Zaun, nicht durch offene Grenzen. Sie wird gemildert durch die Sicherheit: Was auch kommen mag – niemand wird zurückgelassen, keiner muss im Elend verrecken, wer er auch sei", so die Sprecherin der Plattform Radikale Linke abschließend.#LeaveNoOneBehind #WirHabenPlatz #EvacuateMoria

Open the hotels – Evacuate Moria – Shutdown Capitalism!

Today, Monday, activists* placed a banner on the Hotel Intercontinental in Vienna to draw attention to the fact that while hundreds of hotels stand unused, thousands of refugees have to live in camps on the Greek islands. The already extremely precarious situation in these camps is massively aggravated by the threat of an outbreak of the coronavirus. This is due to the border policy of the European Union and its Member States, which has been inhuman for years, and which is supported and driven forward by the Austrian Government headed by Chancellor Kurz.

The activists* demand the immediate evacuation of the camp Moria and the welcoming of people seeking protection in the empty hotels. They also demand the closure of all camps, the release of all persons in detention pending deportation and the abolition of the murderous EU border regime. “Everyone is afraid of the future. It is reinforced by deportations, by the misery behind the fence, not by open borders. It is mitigated by security: whatever comes – no one is left behind, no one has to die in misery, whoever they may be”, the spokeswoman of the Plattform Radikale Linke Platform Radical Left concluded.

Während für zehntausende Spargelstecher*innen eine Luftbrücke eingerichtet wird und hunderttausende Hotelzimmer leerstehen, werden die Menschen in Moria, in der EU, zum Sterben zurückgelassen. The time for pleading is long gone. The situation in the refugee camps on the Greek islands is a humanitarian disaster. Today we have occupied the Ibis-Hotel at Rosenthaler Platz as part of our week of action EVACUATE MORIA – SHUT DOWN CAPITALISM. While an airlift is being set up for tens of thousands of asparagus cutters and hundreds of thousands of hotel rooms are empty, the people of Moria, in the EU, are left to die. This is the murderous logic of state, nation and capital. We demand: Get the people out! Open borders, safe escape routes and an unconditional right of residence for all.“





After the evacuation of all refugee camps people still need safe escape routes and a right of residence! Enough hotels are empty! Thats why we occupied an empty Ibis Hotel!

Day of Rage – Call to action on May 8th

Dear friends, dear comrades,

We migrant self-organisations call on our siblings to join us for a day of enragement and a general strike on 8 May 2020. We call on people with migration heritage, Jewish people, BIPoCs and all people in solidarity to strike with us.

Why the 08 May? The date is considered the day of liberation. But while the war and the Nazi dictatorship came to an end, the Nazi ideology and its representatives lived on and so racism and anti-semitism have a long tradition in Germany. After the end of the Second World War, Germany was at most only symbolically denazified. Former members and functionaries of the NSDAP and SA held political offices here and in Europe after 1945 or ran successful businesses.

Already in the 1950s, there were acts of racist violence. In 1979, Cuban contract workers Raúl García Paret and Delfin Guerra were killed in the GDR during resistance to racist violence. During this time, attacks on immigrants were poorly or not at all documented and so we do not know all the names of victims of racist violence. But the list of names of victims we know is long and apparently endless.

On Thursday, February 19, 2020, nine people with migration heritage were shot dead by a racist in Hanau, five others were injured.

To this day, politics watches as our siblings, friends and our anti-fascist comrades are killed, even in the custody of state institutions, therefore we cannot rely on them. They do not protect us and at the very least since the NSU we know that in Germany, in all likelihood, protection of perpetrators continues.

We are not silent, we are not intimidated, we do not engage in racist discussions, we do not abandon the streets to Nazis. If Germany wants to continue to cosy up to Nazis, we will have no part in it!

Call from Migrantifa Berlin

We cannot rely on the State – self-organize migrant protection and denazify all state apparatuses now!

We join our brothers* and sisters* in a call for all people with migration experience and inheritance, all Jewish persons, Sinti and Romani persons, Black, Indigenous, and People of Color, and all those who feel solidarity with us, to come together and express our rage, our grief, our remembrance, and our resistance.

May 8th is commemorated as “Tag der Befreiung” to celebrate our liberation from National Socialism – this year in Berlin it will be a legal public holiday for the very first time. Although the war and the national socialist dictatorship ended in Europe, the fascist, racist, and antisemitic ideology of National Socialism lives on. Not four years following the end of the Second World War, voices from the political and social spheres loudly demanded a stop to denazification. So it is not at all surprising that shortly after 1945 thousands of former members and officials of the NSDAP (National Socialist German Workers’ Party) took over leading positions in politics, the justice system, national security, and the economy.

Seventy-five years after “liberation” we see a Germany where, once again, fascists and racists march on the streets and commit murder, where they insert right-wing ideology in parliaments, schools, and the police force under the guise of democracy and freedom of expression. Germany has once again become a leading player on the world stage, and it will ensure that its “interests” are enforced in order to secure its “prosperity” – no matter what the cost.

The pogroms in Rostock-Lichtenhagen, the attempted murder in Mölln, the National Socialist Underground affair (NSU-Komplex), the murders of Oury Jalloh in Dessau, Burak Bektaş in Berlin, and, most recently, Arkan Hussein K. in Celle, the attacks in Halle and in Hanau, as well as the daily murders at the European borders – all these are just a few of the thousands manifestations of the fight between an imaginary “inside” and “outside.”

It is not a poison that is responsible for this, but a State that fuels and legitimizes a racist and nationalist ideology by prioritizing national interests and by propagating a value system of “useful versus useless.” And at the same time, it is also the State that protects right-wing perpetrators with its bloody hands: relatives are blamed, files get shredded, deals are struck with dictators, and the right of asylum readily suspended. Evidently, racism and right-wing extermination ideology is not a matter of a few mentally unstable individuals. It is a structural problem within mainstream society, one that is inherent to the logic of the bourgeois State and its institutions.

So we call out and say: Enough! We will not let ourselves be divided and we refuse to tolerate more racism, more fascism, and more murders in Germany! Let us take up the torch of our parents and grandparents and continue the struggle! Let us bring our voices together loudly and express our rage, our grief, and our resolve – whether on our balconies or on the street, from a place of anger or remembrance, for the right to come, to stay and to leave, online or offline. We will exercise our rights, we will make others uncomfortable, we will organize ourselves – beyond borders, for social justice, and in solidarity and remembrance for all those affected by right-wing and racist violence! There will be no final stroke!

German asparagus tastes like exploitation – Update on season workers protest in Bornheim

Hundreds of syndicalists and activists expressed on Monday solidarity with the wild strike of the Asparagus harvest workers in #Bornheim between Bonn and Cologne in Germany.

Last Friday hundreds of seasonal workers stopped work on the asparagus and strawberry fields, whereupon the management of the company called the police to intimidate them. Like thousands of other seasonal workers, the harvest workers in Bornheim live and work under catastrophic conditions: The wages of the now insolvent Spargelhof Ritter were kept, the accommodation is under inhumane conditions – an imminent homelessness could be averted. The workers complain not only about mouldy food, unheated mass accommodation next to a sewage plant and a complete lack of protection against corona – but also about not being paid. They had only been paid 100 to 250 Euros for a month of hard work.

The company belongs (or belonged until a few months ago) to the Ritter family, but has been in insolvency administration since the beginning of March. Andreas Schulte-Beckhausen’s lawyer’s office is responsible, and according to media reports it already has a new investor for the large company on hand. In the main season, the farm is said to have employed up to 500 harvest workers in the years before.

The protest began on Monday at the accommodation containers and continued at the company farm. Tough negotiations were held all day. Around 3 pm the situation comes to a critical point. Suddenly it is said that the payment of outstanding wages should take place on the farm.  A police chain awaits them there, and two security men are also there, who were very aggressive towards union organisers. They say that money should only be given to people who are on an ominous list. The assumption was obvious that the strategy of the insolvency administrator was to set the employees against each other, in which some paid 600 Euros and others only 50 or 70. The lawyer from the insolvency administration came out and sat in the car. He drove away. People were yelling that they want their money. The police protected the car and partly took action against the field workers. Outrage reigns.

Where the isolation of the migrant workers from the rest of the world usually leads to that this over-exploitation being largely ignored, the joint organisation with FAU Bonn was able to cause a nationwide sensation. It was a difficult day as FAU Bonn tweets: “A bone-crushing day draws to a close. Even if we cannot be satisfied with the result: that wages of a few hundred euros were paid at all is a panic reaction of the class enemy. Tomorrow is round 2.”

German agriculture is largely based on low-wage work performed by migrant workers. About 300,000 seasonal migrant workers come every year to Germany to work in the fields. Shifts of 14 hours, seven days a week for unhealthy heavy work are not uncommon. They work and live under catastrophic conditions and are mostly isolated from the outside world from the time they are picked up and taken to their accommodation in order to maintain the over-exploitation of migrant labour.

Now it is important to continue to maintain solidarity with the workers and not to be satisfied with the payment of small amounts of money.

Therefore, come to Bonn (Oxfordstraße 2) tomorrow at 10 a.m. in front of the seat of the insolvency administration, which is in charge of paying out the wages.

Europe – Nothing but a shame – Statements by youngsters from Moria

For more than two weeks, young people from Fridays For Future in Germany have been on hunger strike. From the very beginning the protesters in Germany tried to establish a contact to youngsters at the Moria refugee camp. At a joint press conference on 19th of May, young people from the Moria slum camp prepared and read out very moving statements. Two youngsters from the small German town of Landau. Under the name “Colored Rain” they called on people to join their protest. Sooner said than done: Another hunger strike by a person from Dresden followed. Also in Trier two other activists joined the action. On May 19, the hunger strike in Landau was ended by a protest march to the state capital Mainz. There their demands were symbolically handed over to the state government. Earlier, the activist from Dresden had already ended his action, while the hunger strike in Trier continues.

The youths criticized above all the inactivity of the politicians in meeting the demand to evacuate the camps. Even if the hungerstrike is now partly done, the exchange between the young comrades from Germany and Moria is still active. This is an important thing to strengthen each other and create a common understanding of a joined fight against the border regime.

The situation has not improved. The European migration regime is too deeply inhumane, Moria is an example of this. So let us fight together to counter the policy of exclusion and dehumanisation. The words of the young people of Moria urge us not to give up this fight!

In Moria, at days I’m facing to the danger which is treating people’s lives all around the world, COVID-19, which is treating my life as well because in this camp, unlike the rest of the world which people have the ability to protect themselves from this virus by washing their hands frequently, keeping their distance from each other or even having sufficient and suitable medical equipments and supplies to be far from getting infected by this virus, we don’t have enough medical supplies, we don’t have enough water to wash our hands, even we can’t keep our distance between each other because of long lines like food lines, shower lines, toilet lines, market lines, Doctor lines or even ATM line, and the reason is that because it is an overcrowded camp. And at nights I’m facing to the danger of being injured or killed in huge fights between refugees, which keeps me awake for hours at nights. I have to be awake in nights when fights are happening because of my safety.

Europe was a strong big hope for me like a narrow bright light in the deepest terrifying darkness days of my life, but Moria proved that it was nothing but an imagination and took that light from me and took me to another deepest terrifying darkness days of my life again in another place.

Three days ago a fight happened between volunteers of Movement and Team humanity, it was a huge fight more than five people were stabbed and police did nothing, later that day at night there was another fight between two Hazara and Panjshiri nations and I am pretty sure more than fifteen people were stabbed that night, in that morning I witnessed cut fingers on the ground.

Is that the how safe Europe is? Is this the humanity they are always talking about?

Migrant agricultural workers strike in Germany

The wildcat strike of Romanian agricultural workers in Bornheim shows that struggles are possible even under conditions of racist super-exploitation. Originally published on

On Friday, 15th of May, some of the 250 seasonal workers of the Spargel Ritter company in Bornheim (North Rhine-Westphalia) stopped working in the asparagus and strawberry fields and informed the local press. Management called the police, but the intimidation attempt failed. The strike was covered widely by the media.

The workers are angry because they received ridiculously low wages of 100 to 250 euros instead of the promised 1,500 to 2,000 euros, and because they are housed under inhuman conditions in a container warehouse, idyllically located between a cemetery and a sewage plant on a vacant building site. As a result of the strike, they were immediately threatened with early dismissal and expulsion from their accommodation. Spargel Ritter has been bankrupt since March 1st, according to other sources even since January, and is now managed by the law firm Andreas Schulte-Beckhausen in nearby Bonn. In April, the firm hired both foreign seasonal workers and labourers from Germany without informing them that the company is in a state of insolvency. Obviously the insolvency administrator is using all means necessary to make the company attractive to new investors.

The protest continued on Monday, 18th of May with a rally organised by the anarcho-syndicalist trade union FAU at the accommodation containers, which was attended by about a hundred external supporters. Women workers in particular protested against their exploitation, making impressive and angry speeches. Afterwards, all of them demonstrated together in front of the company’s nearby yard, where some of the outstanding wages were alleged to be paid. Instead, the workers were expected by a chain of police officers and aggressive security guards. It quickly became clear that the strategy of the insolvency administrator was to divide the workers and set them against each other: Some were paid 600 euros, others only 50 or 70 euros. The security guards opposed the presence of a FAU lawyer during the payments, until the police enforced the lawyer’s presence. While the isolation of migrant workers usually means that this type of super-exploitation is largely ignored, the Bornheim case caused a nationwide sensation. Monday was a difficult day, as FAU Bonn tweeted: “A hard day is coming to an end. Even though we cannot be satisfied with the result: The fact that the wages of a few hundred euros were paid at all is a panic reaction of the class enemy. Tomorrow we will enter round 2.”

On Tuesday, the seasonal workers and solidarity activists met for another rally, this time in downtown Bonn, outside the insolvency administrator’s office. From there they went to the Romanian Consulate General, where a delegation of ten workers was received. The consul admonished the workers to be calm and considerate. They should return to their accommodation and wait – because the Consul is in contact with the Romanian Minister of Labour Violeta Alexandru, who is in Berlin at the invitation of the German Minister of Agriculture Julia Klöckner. According to the Consul her second stop after Berlin happened to be Bonn anyway, where she would meet with the Farmers’ Union.

On Wednesday, the minister actually showed up at the lodgings. After a long conversation with the Romanian workers – in which no trade union representatives were allowed – she announced that “everything was settled”: the insolvency administrator had assured her that she would push ahead with the payments, and her ministry would organize a free return to Romania or, in agreement with the German Farmers’ Union, the transfer to another company. After their departure, buses picked up groups of ten workers each for payment at an unknown location. The supporters together with the workers were able to make sure that a lawyer and interpreters were present for all payments, but they had to hand in their mobile phones first.

Since this dubious payment procedure could not be trusted, supporters followed the buses to “unknown places”, which a visibly disoriented police officer tried to prevent them from doing. It came to absurd wild-west-style chases across the strawberry fields, until the busses stopped at a field, where the payments were made in the burning sun. The lawyer made sure that the workers didn’t sign any termination agreements, and many gave him the power of attorney to check their wage claims in court. The FAU announced on Wednesday evening that the minimum target had been reached.

Systematic division

The fact that not all the workers from Romania and a few from Poland took part in the strike is due to the division caused by different contracts. Those workers with contracts running until September instead of only until June who were also promised higher wages saw their contracts of employment endangered by the strike and criticised the unrest that had arisen. In addition to the foreign seasonal workers, about 200 labourers from Germany have been hired since the end of April. As one worker from this group told us, they are called the “German team”, even though they come from all kinds of countries, but are resident in Germany. It is a motley crew – young people who have responded to the call to help “our” farmers to protect the harvest, and people who simply need the money urgently because of short-time work or unemployment. Unlike the workers from Eastern Europe, they are not employed on a piecework basis, but on an hourly wage, and receive a few cents more than the minimum wage of 9.35 euros, to mark the racist differentiation. Another reason for this is that the untrained workers from Germany would not have been able to work at the same pace as the Eastern European workers, who have been doing this kind of work for longer.

At work, the “German” and “Romanian” columns – these are the divisive terms used by the bosses and their foremen – are kept strictly separate when working in the strawberry tunnels, but they run into each other when the full crates are handed over. However, communication usually fails because of the language barrier. On Friday it was noticed that the “Romanian column” was missing, but it seems that word of the strike didn’t get around to the “German column” until Saturday. After the “German column” had continued working on Saturday and Monday, they were sent home for a day on Tuesday because according to the bosses the situation was too heated.

In the past weeks there have been increasing reports on the miserable working and living conditions of agricultural and slaughterhouse workers in Germany. The main reasons for this are the inhumane living conditions to which the workers are exposed and which are even more threatening in the current corona situation due to the lack of protection against infections. While Germany celebrates its low number of cases, it is not surprising that infections break out in places where people live and work under particularly precarious conditions. The refugee accommodation in Sankt Augustin, the slaughterhouse in Dissen and a deceased Romanian field worker in Baden-Württemberg are examples of these scandalous conditions.

A wildcat strike, from which we can learn a lot

The Romanian field workers were initially left on their own. Their outcry was heard by left-wing supporters – above all the FAU. And what about the IG BAU, the mainstream construction union? And the DGB federation? Members of parliament? No chance! With little money and few resources, FAU Bonn managed to support the workers in every step, despite the language barrier – a prime example of concrete solidarity.

This struggle shows above all that even the precarious and unorganised can defend themselves. This experience gives courage for the future. And it remains to be seen whether those who have now been placed on other farms through the Farmers’ Union will carry the strike virus to other fields. In Romania, all major daily newspapers have reported on the strike in Bornheim. This, too, could strengthen the self-confidence and entitlement of the seasonal workers.

In the Corona crisis, in view of the danger of infection, numerous social grievances have become the subject of discussion, which were already disastrous before Corona, but remained hidden for years. In a situation of crisis, people might initially deal with the burdens and troubles on an individual level. But in various sectors, micro-processes of resistance are currently taking place that can easily develop into collective struggles. In some cases these struggles come together, in others the divisions and hierarchies need to be broken through.

Minneapolis Explodes Against The Police In Wake Of George Floyd’s Murder

The streets of Minneapolis exploded on Tuesday evening, following the horrific murder of a 46 year-old African-American man, George Floyd, at the hands of white police officers on Monday. In a now viral video, Floyd’s grizzly murder was captured on film, as a white police officer held his knee on Floyd’s neck while he lie on the ground for several minutes, as an angry crowd gathered and recorded the killing. In the video, Floyd can be heard saying that he was not able to breathe, echoing the words last spoken by Eric Garner, who was also killed by police in 2014 in a similar incident in New York.

Overnight, video of the attempted arrest circulated on social media. Posted by Darnella Frazier on Facebook,the nine-minute video shows a white officer pressing his knee into Floyd’s neck behind a squad car. While lying facedown on the road, Floyd repeatedly groans and says he can’t breathe.

“He’s not even resisting arrest right now, bro,” one bystander tells the white officer and his partner, in the video. “You’re f—ing stopping his breathing right now, you think that’s cool?”

After about five minutes, Floyd stops moving and appears unconscious. People in the gathering crowd plead for the officers to check Floyd’s pulse. The officer on Floyd’s neck does not lift his knee until medical personnel arrive and carry him to an ambulance.

Directly following the video of Floyd’s murder going viral, all four of the officers that were involved in the killing were fired, a rarity in cases involving police deadly use of force. Multiple media outlets also reported that the FBI is now investigating the killing “for possible civil-rights violations.” According to Mapping Police Violence, police are charged with a crime following deadly encounters only 1.7% of the time. Data from Killed By Police, a website which tracks police killings, shows that at least 400 people have been killed by law enforcement in 2020, making for an average of around 3 people per day.

Despite expected heavy rains and the firing of the four officers, the demonstration on Tuesday evening brought out thousands of people onto the streets; the vast majority of them wearing masks to prevent the spread of the coronavirus. Arial shots of the demonstration show it stretching across several city blocks. According to folks on the ground, actions happened throughout the city. At the intersection where George Floyd was murdered, there was a continuous gathering and street blockade. Marches on Tuesday took off from various points; collectively converging on the 3rd precinct. During one of these marches, anti-police graffiti slogans were extensively painted. Upon converging at the precinct, the massive crowd surrounded the building and the front window of the precinct was busted out and people began to write slogans on police cars and building walls, while others pelted other windows with eggs and projectiles. People then began attempting to break out more windows before being repelled by police tear gas from officers inside the building.

It should also be noted that during this time, other demonstrations were also taking place – outside of the home of Derek Chauvin, the now fired police officer at the center of the video showing the murder of George Floyd. Posts to social media show large crowds outside of the home of the former officer with one person commenting that several attempts at food delivery had been turned away, “So he’s in there hungry. Hope he’s fucking scared.” Chauvin lives in Oakdale, a suburb of St. Paul, “joining the estimated 94 percent (in 2014) of Minneapolis police officers who live outside the city,” according to one local news report.

Meanwhile, back at the 3rd precinct, during this chaos, various “peace police” attempted to contain the crowd, trying to get them to stop attacking police property, yet these cries fell almost completely on deaf ears. A group of police wearing gas masks were then successful in pushing the crowd away from the building and towards the police parking lot, where people began to tear open fences to vandalize and attack a variety of police vehicles; breaking out windows, mirrors, popping tires and spray painting slogans.

Battles raged for hours outside MPD's 3rd precinct. After the building was tagged, its windows smashed, and the parking lot gate broken open to allow people to sabotage their vehicles, police fired massive amounts of tear gas in a futile attempt to disperse the crowd.

Enraged, police then began shooting massive amounts of projectile weapons and tear-gas into the parking lot, pushing people onto the adjacent street, and away from their vehicles. Unicorn Riot reported on the ground that these tear-gas canisters led to a series of small fires, which were quickly put out by demonstrators, who also threw the tear gas back towards the police. Officers also shot off large amounts of “marker rounds,” which left large blotches of paint behind when fired; marking an individual for possible later arrest.

Over the next several hours, running street battles took place between protesters and law enforcement, much of it within the parking lot of the nearby Target store. Rioters built barricades with shopping cars while police attacked the crowd indiscriminately. Those on the streets, many very young, acted bravely in the face of intense police violence, protecting each other, treating tear-gas, and throwing back smoke canisters. As the evening wore on, people also looted the nearby liquor store and smaller clashes continued to break out with police until the early morning of Wednesday.

A Minneapolis City Council member described the police violence on Twitter, writing:

This is a disgusting display. I’m here on the southside, helping people as I can with milk, water, and towels. So far, I have been unable to prevent the police from firing indiscriminately into the crowd. Moments ago, I held a towel to a teenage girls head as blood poured from it.

Teargas and "marker" rounds are products of Defense Technology, owned by Safariland, a riot control corporation in the US that supplies governments around the world in counter-insurgency projectiles, from Ferguson to Gaza.

The uprising comes after several months of rising unemployment and massive State failure in the face of the coronavirus, which so-far has led to the deaths of over 100,000 people. People in the so-called US have also watched over the past month as both elite interests and neo-fascist groups have pushed jointly for the economy to “ReOpen,” which has only solidified poor and working-people, often of color, being placed onto the front lines of the pandemic. The fact that police have shown heavily armed far-Right protesters nothing but kid gloves for the past month at various “ReOpen” rallies was also not lost on anyone, and many on social media pointed out the vast difference in police response. Ironically, several far-Right “Boogaloo” protesters did try and intervene in support of the demonstrations in Minneapolis, only to be quickly shown the door.

The Minneapolis Uprising will surely be seen as a turning point in 2020, not only in terms of marking the first large scale grassroots rebellion against the State in the midst of the COVID-19 pandemic in the US, but also because it showed the drive of the people to take action in the face of various forces attempting to push them off the streets. But from activist protest managers, to police with high grade firepower, to even the State’s quick rush to fire the officers involved in the killing, all efforts failed in putting a wet blanket over the popular rage of the thousands who turned up Tuesday night and made chants of, “No Justice, No Peace,” not just an empty threat, but a promise of total ungovernability.

As the gates to the 3rd precinct's parking lot were being opened, many of the building's windows & doors were showing obvious signs of damage.

On Wednesday, May 27th, the City of Minneapolis began construction of a metal fence around the 3rd precinct, as new protests began in the streets.

The city of Minneapolis is literally BUILDING AN ENTIRE WALL around the 3rd Police Precinct on Minnehaha Avenue. They are more concerned about protecting a building than they are with the sanctity or Black life. #JusticeForGeorgeFloyd

Climate justice or brawl!

The world is in flames and they continue to play with fire. Every day they dig up coal and burn it in their power plants, even though they know that this is the biggest source of CO2. Even though they know that in the next few years we are heading for tipping points that will make the climate catastrophe irreversible.

They, that is RWE AG, the energy-dependent industry, that is investors who are relying on everything going on as before. They are the federal and state government and the German-dominated European Commission. All those involved know what’s happening, and coal is still being produced.

Angela Merkel and other politicians looked at the appeals and mass demonstrations with a slight nod, but they weren’t really impressed. The coal phase-out should continue to come only when the last piece of coal has actually been burned. Because as someone once said: The modern state power is only a committee that manages the common business of the whole capitalist class. But we cannot expect anything else, because fossil capital provides the energy for the entire class. And the unity of property and the existing order is vehemently defended. As much as some may wish for a green capitalism: it will never be, because there is no decoupling of growth and resource consumption – these are just fantasies. The ruling class is the idealist, dreamer, unworldly.

It has broken its own announcements, self-commitments, etc., all by itself. All it has managed, since it has known about climate change, is to export environmental destruction itself. Even if coal is no longer burned in the Federal Republic and the industry is otherwise conserving resources here, environmental destruction will continue to be outsourced under capitalism if necessary. As always those people worldwide, who cannot afford to protect themselves, are most affected by capitalism and its environmental destruction.

Those responsible are the saboteurs of any effective climate policy and any humane coexistence, because the latter stand in the way of their business model and growth compulsion. They threaten to sue the states if their operating license is revoked. They threaten to leave workers in poverty and to worsen working conditions. They take away people’s time, our health and the resources we need to live. They will not stop their sabotage by themselves, they must be stopped. And if no one else can stop them, we must. If we stop their machines, we drive up the costs. Until it no longer pays off. We will stop the madness where it takes place. That is why we are joining the actions of Ende Gelände in the Rhineland from September 23 – 27, 2020.

Let us sabotage the saboteurs.

A Beyond Europe call to keep up the pressure and fight for solidarity.


After the fire that destroyed the misery camp of Moria, those who have nothing are not only left in the ashes of the monster of European foreign policy, but are now also being trampled on.

The refugees who did not manage to flee from the camp and escape to the city were not provided with blankets, tents and water, but with tear gas and the sticks of the Greek police. The cops tried with all their might not to let the refugees leave the camp, while what little they left behind remains was burned the next night. Trapped on the island’s streets around the camp, they were surrounded by riot police, left alone, without sufficient food, water and medical care. Helpers, NGOs and journalists were largely kept away, leaving the people defenceless against the heat of the day, the cold of the night, the arbitrariness and violence of the police and the attacks of local fascists.

For the verdict of the ultra-conservative Greek government under Nea Demokratia had already been passed. The guilty ones were those who had been locked up for years in the hell of Moria in disregard of human rights, and those who tried to alleviate the greatest suffering or to make the conditions public. Their guilt was investigated where there was nothing left to investigate, in the remains of Moria, already pushed together by bulldozers. But the Greek propaganda must be confirmed, on the one hand to distract from their own guilt and on the other hand to curb the biggest fear of the European Union. The fear that the fire that destroyed Moria will spread to the countless other places in the EU, based on the same inhuman policy. Whether in Lampedusa, Cyprus, Spain or along the entire Balkan route, the border regime has created places that are not far behind Moria. Where people are imprisoned without dignity, without opportunities and without any perspective. Moria is not the only powder keg that the EU has created in recent years.

While the people of Lesvos are suffering, the European politicians responsible for this catastrophe are extremely concerned. However, lip service is still paid without insight and concrete measures to help.  Under the leadership of Germany there is a diligent haggling about responsibility and ridiculous contingents, legitimized with excuses and the search for common European solutions.

Despite their situation and the repression, many people are still demonstrating. They demand freedom and do not want to be resettled in a new closed camp under any circumstances. They are disappointed and tired of the promises of European politicians. Many understand all too well by now that they have become a plaything and are being used as a warning to break the idea of the Summer of Migration 2015, the idea of a Europe of human rights, whose ashes are carried away by the wind, sinking into the Mediterranean.

The Greek state is trying to blackmail the refugees into the new closed camps through lack of supplies, the continuing great danger of Covid-19, the threat that their asylum procedure will be suspended and permanent police arbitrariness and violence. How long their resistance can hold under this pressure is uncertain and therefore it is up to us to support their struggle and make it ours.

The refugees clearly show that they do not want to be numbers anymore and that dehumanization has come to an end. They want to fight for their rights, their future, their security and their lives. A fight for the foundation of our society that shows whether human rights are universal or remain a privilege. Because in this world of exploitation and competition, on the last islands of wealth, there is not enough space for those who seem superfluous.

Moria is a magnifying glass for the mistakes of the capitalist society we live in, and an example of how the smoking remnants will only be preserved by increasingly authoritarian measures of the state. A foul and dirty deal with despot Erdogan was made and inhumane camps were created with no concept at all. No wonder, since a bunch of European states are led by far right or right-populist governments, who hijack international decision making to impose their idea of society: authoritarian on the inside, locked up for the outside.

From 2015 till now, the EU did not even come close to find a common strategy to deal with refugees arriving at European borders. Those refugees, the people, who have to flee their own countries from war, ecological, social and economic catastrophes. The effects of global capitalist businesses, which make many parts of Europe rich.

Throughout Europe, there have been various solidarity actions in favour of evacuating the camps, not only in Moria, but on the whole external borders of the EU. But neither the pressure in the streets nor the public discourse was enough to make the rulers act effectively, which they simply do not want.

This Sunday on 20.09. people will again take to the streets in countless cities.  We must not try to keep up the appearance of the European values, which were burnt in Moria, but to stand up for something completely different. A society that is based on solidarity and equality and that creates livable spaces everywhere without destroying the basis of life of the people.

After all, Solidarity is the key. Today, it is vital to stand up for solidarity and freedom of movement for everyone. These buzzwords used to be our own labels for assuring ourselves of our own radical views. In these times, solidarity and freedom of movement are still radical. They are ideas from which we can advance a radical critique of capitalism. The difference is that many more people are open to these demands, because after years and years of tens of thousands killed at borders such as in the Meditarranean, the critique of the status quo goes far beyond the usual suspects. When we take solidarity and freedom of movement to the streets today, after the disaster of Moria, it is not to be a small and hopefully radical voice in the discourse, but it is to change something politically: Evacuate now. End the camps. Fight the Fortress.

The Beach Lies Beneath the Streets – End Automotive Capitalism!

It is well known, that the efficiency of the German industry is only surpassed by the ingenuity of German politics. SUVs and Diesel-Gate, arms exports and coal mining, VW and BMW, Armin Laschet  and Annalena Baerbock. All of these are expressions of German drive and inventiveness, and will be lovingly displayed at this year’s International Motor Show (the IAA Mobility) in Munich. Anyone who wishes to see what will move tomorrow can admire it here, the favorite new export: e-mobility. So hail to the big new electric vehicles, and goodbye dear useless climate goals. Because only if everything is nicely coated in green ideology without actually changing the way we interact with the earth, will webe able to remain at least the vice world export champion and be allowed to keep our little Porsche Cayenne. Now with a lithium battery.
The automotive vision of a green future is just another version of dystopia. A society guided by never ending capitalist growth instead of ecological tipping points. A world that we believe to be crazy, without knowing any other.
To make sure that the the car industry and the entire car-dependent country can continue on the ruinous path, the so-called “green IAA” in Munich presents itself as a state banquet for e-mobility, and offers legitimacy to a destructive sector.  But no motor show, however glamorous, can hide, that the German industry works hard in the field of production and enhancement of the climate crisis: Here we can see, how continuous growth compulsion and aggressive nationalism as well as specific forms of patriarchal and neocolonial structures are upheld. These are reasons enough to take on the IAA and the German automotive industry.
Green State Theater in Brown Car Country 
A straightforward drive into the collapse of the climate – at least it seems like that’s what the government and industry in Germany is aiming for. Since the alliance between the two is always oriented toward capitalist growth, their helpless and at the same time aggressive response to the climate crisis is predictable – even though devastating floods are raging through their own country.
Because it rattles investment risks for German automotive companies if the nation’s poster child fails to do its homework on the “Green New Deal,” business and politics are under pressure to act: that’s precisely where this year’s International Motor Show is intended to remedy the situation. While the high-emission transport sector and thus also the German automotive industry are merely being given a new type of drive, politicians from Söder to Habeck are running for election with domestic climate protection programs. And sadly, the voters of the conservative and green party are applauding.
When German political celebrities remark that climate protection measures may not endanger national competitiveness, this claim shows the violence that is adorned by the free market as with Elon Musk’s visions of Mars. After all, it is so much more entertaining to imagine the fully-automated, luxurious life on Mars, than to have one’s mood spoiled with talk about national economic border regimes and the associated ecological consequences. For these valiant warriors in support of the German economy, the global South is only of interest, if it provides sales markets or raw materials for German carmakers. The prime compentence of the vice world export champion was and remains to be: ruining local economies and livelihoods while glorifying overexploitation of nature as necessary and therefore acceptable. The market regulates and makes sure that German domination of postcolonial areas is actualized in ever new forms: Regions of the world that, as former colonies, were never able to build up a competitive economy, are now also the venue for the climate crisis made in Germany.
Brave New Concrete World 
While the state’s nationalism sorts out the infrastructure and the labor market, BMW, VW et. al. deliver  a blatant vision of the future: “See what moves tomorrow.” Corporations that widely manipulated emission tests only a few years ago, now stage themselves as the solution to the climate crisis at the IAA in Munich. For almost a week, the entire city will be subject to the industry’s PR-stunt. Half of the city center is turned into spaces exhibiting greenwashing, hoping that the public will endorse the project. These so-called open spaces  are linked to the exhibition grounds via the “blue lane” – a test track for the new “sustainable” e-vehicle monsters. 
But you don’t need the IAA’s witless claim to see what the proud automobile state creates: Horrendous amounts of money are poured into the construction and maintenance of a pivotal piece of German heritage: The Autobahn. The countryside is leveled, cities and forests are turned into concrete planes. The so-called car-friendly city is transforming contested public space into automotive property. It is the subjugation of our lives to automobility; it is patriarchy coagulated into asphalt. Because car-oriented urban planning is oriented towards the male work relationship and not towards reproductive work, it builds many and, above all, fast routes between the place of residence and the (male) workplace. It is thus just another facet of binary gender separation.
Nothing to lose?
But the painting of the one green world continues unabated. Under this new slogan, nationalism for the sake of protecting the German econony is what all political parties from the Greens to the Nationalist AfD can agree on, while giving handshakes to the German key industry in front of the new E-mobile. Overcoming the auto industry would take the power out of what the German economic model, so serious climate protection measures are options that are not seriously discussed. While until recently internal combustion SUVs were the best selling vehicles, the turn to battery operated mobility has now been decided in favour of e-mobility. This is because there is no way around exhaust gas limits, moral consumer interests and the impending oil shortage, even for Germany. While Tesla is making the German auto industry look silly, the battle between old diesel fascists and electric disciples in this country has been settled in a statesmanlike manner: direct investments in companies, buyer premiums and charging infrastructure are handed out generously. The new technology is supposed to bail out the German car companies – with a lot of publicity and hoopla: After all, now it’s the car industry saving the planet! 
But nothing at all is being protected; on the contrary, profits are made from the destruction of the climate. Selling the e-car as a “sustainable technology of the future” is the next step in a market logic to re-legitimize the climate-destroying concept of individual, automotive transport and its industry. The production of e-cars causes significantly higher emissions than conventional ones. At the moment, the batteries require the rare raw material lithium, the mining of which causes enormous water pollution and prolongs the exploitation of natural resources in terms of power politics. So while geopolitical interest shifts from oil fields to lithium deposits in South America and the Congo, e-mobility changes nothing in the principle of extractivism. The electric car is not the solution to the problem, it only prolongs and enhances it. 
Fighting in a world in flames
But why paint green what has long been on fire? A realistic answer to the climate crisis is not to be found in the “just keep on doing what you’re doing” of the German auto theater. It is clear for us, that if the state and capital pass the baton to each other, a real mobility turnaround can only be fought for from below and against these alliances. As comprehensive as the seizure of the city of Munich by the automobile industry will be in September, so are the reasons to mess with this close alliance and their showmanship. And this complex show offers a multitude of ways, to interrupt and destroy the show!
If German car companies dare to stage a green Munich Mobility fairy tale in the middle of the escalating climate crisis, we will turn it into a disaster: E-car parties are no reason to celebrate, blocking them is just the beginning! Our answer to the black-green agenda of the IAA 2021 is: Overcome car capitalism, for the socialization of production and mobility, in urban as well as rural areas. Beneath the pavement lies not only the beach, but also a society based on solidarity – Let’s dare to fight for it!
